Your statutory rights remain. These Terms do not exclude consumer protections, privacy rights, or other rights that cannot lawfully be limited. If you obtain ActionBar through the Mac App Store, Apple’s standard end-user license agreement governs the app license, as explained below.

1. Who you are agreeing with

These Terms of Use (“Terms”) are between you and Kimeur Labs, LLC, 4848 Lemmon Ave STE 420, Dallas, TX 75219, United States (“Kimeur Labs,” “we,” “us,” or “our”). They cover actionbarapp.com, our online services, and, as specified below, the direct-download edition of ActionBar (together, the “Services”). ActionBar is a product of Kimeur Labs, LLC.

By using the Services after being given an opportunity to review these Terms, you agree to them to the extent permitted by applicable law. If you do not agree, do not use the Services. Where affirmative acceptance is legally required, merely visiting a page does not replace that requirement. If you use the Services on behalf of an organization, you represent that you are authorized to bind it, and “you” includes that organization.

Our Privacy Policy explains information handling. Agreement to these Terms does not constitute consent to optional analytics, app diagnostics, or any other processing requiring separate consent. A separately signed agreement or mandatory storefront terms control over conflicting provisions of these Terms for their subject matter.

2. ActionBar from the Mac App Store

The license to the Mac App Store edition is governed by Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”), together with applicable Apple usage rules. These Terms are not a custom App Store EULA and do not replace or narrow that license. The direct-download license in section 3 does not apply to an App Store copy.

Kimeur Labs, LLC is the provider of ActionBar. Apple’s role, the applicable app license, and the allocation of responsibilities for support, warranties, and claims are determined by the Apple Standard EULA and applicable law. We provide ActionBar support through our Support page. Nothing here expands Apple’s obligations or limits rights you have under Apple’s terms or mandatory law.

These Terms may govern your separate use of our website and online services, to the extent consistent with the Apple Standard EULA and Apple’s rules. In a conflict concerning an App Store application license, the Apple Standard EULA controls. App Store availability, downloads, updates, transactions, and refunds are also subject to Apple’s applicable terms.

Features differ by edition. The sandboxed Mac App Store edition searches folders you add and does not include script execution, Alfred handoff, or browser-profile launching. A website demonstration of a direct-download feature is not a promise that it is present in the App Store edition. Check the description for the edition and version you obtain.

3. Direct-download software license

For an ActionBar copy obtained directly from us, and subject to these Terms, Kimeur Labs grants you a limited, nonexclusive, nontransferable license to install and use the software on compatible Macs you own or control for your personal or internal business purposes. The software is licensed, not sold. No ownership or other intellectual-property right is transferred to you.

You may make a reasonable backup copy, preserving proprietary notices. You may not redistribute, resell, sublicense, rent, or provide the software as a service to third parties without our permission. You may not modify or create derivative works of our proprietary software, circumvent access protections, or reverse engineer it, except to the extent applicable law expressly permits despite this restriction or a component’s separate license allows. Rights granted by open-source licenses are not limited by this section.

This license covers updates we provide for the direct-download edition unless an update is accompanied by different terms that lawfully apply. It does not promise any particular update, feature, support period, or continued compatibility. Termination is governed by section 15, subject to mandatory law.

4. Eligibility and your device

You must be legally able to enter this agreement. If you are below the age of legal majority, a parent or legal guardian must authorize and supervise your use and agree where applicable law requires. The Services are not directed to children under 13. You may not use them where doing so is unlawful.

You are responsible for a compatible device, a lawful macOS installation, the permissions you grant, network access for online features, and any related third-party costs. Keep your device and credentials secure and maintain appropriate backups. ActionBar does not require an account and is not a backup or secure-vault service.

5. Actions, clipboard history, and your content

ActionBar can launch apps, open files and URLs, copy text, perform calculations, and run supported workflows. The direct-download edition also supports user-configured scripts. You decide which folders to make available and which actions to run. Confirm the destination and effect of an action, particularly when it opens a website, executes a command, or operates on valuable information.

Only install or run scripts and workflows you trust and are authorized to use. Depending on their permissions, third-party commands can change or delete files, access information, or send data over a network. Our software does not make untrusted code safe. You remain responsible for your instructions and content; this does not excuse our own legal obligations or liability that cannot be excluded.

Clipboard history is optional, bounded, and temporary. Sensitive-copy exclusions cannot detect every secret. Do not rely on it as permanent storage or as a guarantee that passwords will never appear. Copying a result replaces the current system clipboard, and clearing ActionBar’s history does not erase information already copied or pasted elsewhere.

Calculations and weather are general convenience features. Verify important results independently; they are not professional advice or appropriate as the sole basis for emergency, safety-critical, medical, legal, financial, navigation, or similar high-consequence decisions. Weather may be delayed, incomplete, or unavailable.

6. Acceptable use

You may use the Services only for lawful purposes and in accordance with applicable third-party terms. You must not:

  • Access, collect, disclose, or use information without the rights and permissions needed, or infringe another person’s privacy, intellectual property, or other rights.
  • Introduce malware, compromise accounts or systems, impersonate others, or use the Services to facilitate fraud, harassment, or other unlawful conduct.
  • Disrupt our infrastructure, overload the weather API, circumvent rate limits or security controls, or access nonpublic systems without authorization.
  • Remove proprietary notices, falsely claim affiliation or endorsement, or distribute unauthorized copies of proprietary software.
  • Use the Services in violation of applicable export controls, trade sanctions, or restrictions on prohibited parties or destinations.

These restrictions do not prohibit conduct protected by mandatory law, permitted interoperability, or authorized security research. Report suspected security issues through our support contact and avoid exposing another person’s information.

7. Intellectual property and feedback

Kimeur Labs and its licensors retain all rights in the Services, software, original designs, documentation, and brand assets, except for rights expressly granted to you. Third-party names, logos, and materials belong to their respective owners. Mentioning or demonstrating a compatible product does not imply sponsorship or endorsement.

You retain rights in your files, clipboard text, scripts, configurations, and other content. These Terms do not give us ownership of your content or a general right to publish it. Information processing is described in our Privacy Policy.

If you voluntarily provide product suggestions, you grant us a nonexclusive, worldwide, royalty-free right to use, adapt, and incorporate that feedback to develop and improve our products without compensation or a duty of confidentiality, unless we separately agree otherwise. This does not authorize publication of your personal information, confidential materials, or unrelated content.

Third-party and open-source components remain subject to their own license notices. Those licenses control for the relevant components if they conflict with these Terms. Nothing here restricts rights those licenses grant.

8. External services and links

Online functions may depend on Apple, Open-Meteo, hosting providers, and other independent services. A search, quicklink, workflow, or external app may be subject to the destination’s terms and privacy policy. We do not control independent providers’ content, availability, or changes, and you must comply with their applicable terms.

Weather data is supplied by Open-Meteo; its service terms and applicable data attribution/license conditions apply to that data. Our use of a provider does not transfer to you a right to resell or directly access its services beyond permissions that provider grants.

This section does not reduce our responsibilities for providers processing personal information on our behalf, for representations we make, or for consumer remedies required by law. Any commercial arrangement we need with our service providers remains our responsibility.

9. Privacy and permissions

Read our Privacy Policy for collection, use, recipients, retention, and deletion information. App analytics, app crash reporting, and clipboard history are separately controlled and off by default. You can change these choices in Settings without accepting a new agreement or losing access to unrelated features.

Online requests necessarily involve network processing. Sending a city for weather, opening an external URL, and running a user-selected script are different from enabling app analytics. You are responsible for obtaining any permission required before processing another person’s information through the actions you configure.

10. Pricing, transactions, and refunds

This website currently does not process payments or enroll you in a subscription. Visiting it, using its previews, or reading these Terms does not create a charge. These Terms do not authorize future recurring billing.

If an edition is offered for a price, its price, applicable taxes, features, and transaction terms must be disclosed at the point of purchase. App Store purchases, if offered, are processed by Apple under its terms; requests concerning those charges or refunds follow Apple’s process and applicable law. We do not receive your full payment-card details from Apple.

Any future paid or subscription offering will require its own clear purchase disclosures and any consent required by law or the storefront. No provision here eliminates mandatory refund, cancellation, conformity, or other consumer rights, or changes a price already agreed for a completed purchase.

11. Availability, updates, and previews

We may maintain, update, change, or discontinue features and services, including online features, for operational, security, legal, or product reasons. Where required, we will give reasonable notice and provide applicable remedies. We do not guarantee uninterrupted operation, compatibility with every device or third-party update, or indefinite availability of a free online feature.

Install updates through the distribution channel for your edition. App Store updates are delivered through Apple’s update mechanisms. You should not treat a roadmap, marketing example, or demonstration as a commitment to a future release date or unannounced feature.

The website’s browser launcher and product films use illustrative sample content. They do not access your native apps or files and are not recordings of your device. Development or preview availability is stated on the download interface. Any beta or prerelease software identified as such may be incomplete or unstable; use appropriate backups.

12. Warranty disclaimer

To the fullest extent permitted by applicable law, the Services covered by these Terms are provided “as is” and “as available.” Kimeur Labs and its licensors disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, and warranties arising from a course of dealing or trade usage. We do not promise that every error will be corrected or that the Services will be uninterrupted, completely secure, or free of errors or harmful components.

This disclaimer does not override express promises in a binding purchase agreement, the Apple Standard EULA for an App Store app license, or guarantees and remedies that mandatory consumer law provides. If your jurisdiction does not permit a disclaimer, it applies only to the extent permitted there.

13. Limitation of liability

Where legally permitted, Kimeur Labs and its licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Services covered by these Terms, including lost profits, business interruption, lost opportunities, or loss of data, even if advised that such loss was possible.

To the extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Services they govern will not exceed the greater of US$100 or the amount you paid Kimeur Labs for the affected Service during the 12 months before the event giving rise to the claim. This limitation applies regardless of the legal theory asserted, but only to liabilities lawfully subject to limitation.

These exclusions and caps do not apply to fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability or remedy that cannot lawfully be excluded or limited. They do not reduce nonwaivable privacy rights or statutory consumer remedies. An App Store app license remains governed by the Apple Standard EULA rather than being modified by this section. If a limitation is not permitted in your jurisdiction, the permitted limitation applies without removing your mandatory rights.

14. Third-party claims against business users

This section applies only if you use the Services for an organization or in a commercial capacity, and only where permitted by law. You agree to indemnify Kimeur Labs against third-party claims and reasonable resulting costs, including reasonable legal fees, caused by your unlawful use of the Services, infringement through content or instructions you supply, or material breach of these Terms.

This obligation does not cover losses caused by our breach, negligence, or misconduct, and does not apply to personal consumer use. We will give reasonably prompt notice of a covered claim, allow a reasonable opportunity to defend it with suitable counsel, and cooperate at your reasonable expense. Neither party may agree to a settlement admitting the other’s fault or imposing nonmonetary obligations on the other without that party’s consent, not to be unreasonably withheld.

15. Ending your use

You may stop using the Services at any time. For a direct-download copy, you may terminate its license by uninstalling it and deleting copies you control. Local data and provider-held data require separate handling as described in our privacy controls; uninstalling is not a server-side deletion request.

Where permitted, we may suspend access to our online services, or terminate the direct-download license for a material breach, legal requirement, or significant security threat. Where reasonable and legally required, we will give notice and an opportunity to remedy a breach. Immediate protective action may be necessary for serious abuse or threats. We do not obtain a right under this provision to delete your personal files.

Termination does not remove accrued rights, required refunds, or mandatory consumer protections. Terms that by their nature should survive, including ownership, lawful liability limitations, and dispute provisions, remain applicable. Termination of an App Store app license is governed by the Apple Standard EULA.

16. Governing law and disputes

Except where mandatory law requires otherwise, Texas law governs these Terms without applying conflict-of-law rules. Subject to the exceptions below, disputes concerning these Terms may be brought in the state or federal courts with appropriate jurisdiction in Dallas County, Texas, and you and Kimeur Labs consent to those courts’ jurisdiction.

If you are a consumer, this choice does not deprive you of mandatory protections of the laws where you habitually reside or a right to bring a claim in a court available to you under applicable law. It does not prevent a complaint to a regulator or access to an eligible small-claims forum. These Terms do not impose mandatory arbitration or a class-action waiver. The Apple Standard EULA’s governing provisions remain applicable to the App Store application license.

You may contact us to try to resolve a concern informally, but doing so is not a condition of exercising a legal right or meeting a filing deadline.

17. Changes and general provisions

We may revise these Terms prospectively. We will post the updated text and effective date and provide additional notice of material changes where appropriate or legally required. We will seek affirmative agreement where required. Changes do not retroactively remove accrued rights or alter a dispute that has already arisen. If you do not agree to validly notified changes, stop using the affected Services, subject to your existing purchase and statutory rights.

If a provision is unenforceable, it is limited or severed to the minimum extent necessary, and the rest remains effective. A failure to enforce a provision is not a waiver. You may not assign rights or obligations under these Terms without our consent except where law permits; we may transfer them in a legitimate business reorganization or transfer only subject to your mandatory rights and applicable notice requirements.

These Terms and any applicable purchase or separately signed agreement form the agreement for their subject matter. They do not displace the Apple Standard EULA, third-party component licenses, or rights that law preserves. No agency, employment, joint venture, or partnership is created. Except as another applicable agreement provides, these Terms do not create third-party beneficiary rights.
